Also, register the&nbsp;<strong>undivided share<\/strong>&nbsp;of\nland&nbsp;<strong>(UDS)<\/strong>&nbsp;of newly completed buildings.&nbsp;<\/p>\n\n\n\n<p>The\ninspector general of registration has clarified that there would be the\ninclusion of the value of newly built apartments or the value of construction\nagreement in the sale deed along with the value of UDS if the building has\nobtained completion certificate. The buyer needs to pay only 2% that is 1%&nbsp;<strong>stamp duty<\/strong>&nbsp;and\n1%&nbsp;<strong>registration<\/strong>&nbsp;fees for registering the\nconstruction agreement. When the building is excluded in the sale deed, the\nsaving for the buyer is 9% of the cost of the building. However, on the other\nside, there is no sale deed generated for a new apartment when the first sale\ntakes place. When the same apartment is resold, the buyer has to pay 11% stamp\nduty and registration fees from USD and the value of the apartment. In effect,\nthe building gets a sale deed only in the second sale.&nbsp;<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Sub-registrars_refuse_to_include_USD\"><\/span>Sub-registrars refuse to include USD<span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>Many\nsub-registrars were refusing to include USD alone in the sale deed of completed\nbuildings even it is the first sale. They contended that there cannot be a\nconstruction agreement between buyer and developer when the building is completed\nand the regulatory agency (like CMDA or DTCP) has issued a completion\ncertificate. Hence for completed buildings, like in the case of the second\nsale, both <strong>UDS<\/strong> and should be\ncomprised of the building\u2019s value in the sale deed, they insisted.&nbsp;<\/p>\n\n\n\n<p>The\ndeveloper community has been arguing that even after obtaining the completion\ncertificate, many works would be pending in the apartment, which may consist of\nvarious alterations. Hence for all practical purposes, the building must be\ntreated as incomplete.<\/p>\n\n\n\n<p>To conclude with, building under construction and completion buildings can be treated on par for registration purpose.
