In Hindi, the encumbrance certificate is commonly known as \u2018<em>bhar-mukt praman<\/em>\u2019. The \u2018Encumbrance Certificate\u2019 or \u2018Non-encumbrance certificate\u2019 acts as evidence that the property has a free title and ownership. When an individual decides to buy a house, the encumbrance certificate can be used to see whether the property is free from legal and monetary liabilities.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_Required_to_obtain_an_Encumbrance_Certificate\"><\/span><strong>Documents Required to obtain an Encumbrance Certificate<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>Some of the documents that are required are:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Property details<\/li><li>Deed details<\/li><li>The deed number which is received on registration contains the date and book number along with the signature of the applicant.<\/li><li>The property sale deed\/partition deed\/gift deed\/ release deed if the deed has been executed previously.<\/li><li>Address proof of the applicant.<\/li><li>Property registration document.<\/li><\/ol>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Types_Of_Encumbrance_Certificate\"><\/span><strong>Types Of Encumbrance Certificate&nbsp;<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>Encumbrance certificates are of two types:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Form 15:<\/strong> If the property in question has any encumbrances during the period for which the applicant has sought a certificate, the sub-registrar\u2019s office issues an encumbrance certificate on Form 15.<\/li><li><strong>Form 16:<\/strong> If any property has not registered any encumbrances during the period for which the applicant has sought a certificate, the sub-registrar\u2019s office issues a nil-encumbrance certificate on Form 16.<\/li><\/ol>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Online_Application_Process_for_an_Encumbrance_Certificate\"><\/span><strong>Online Application Process for an Encumbrance Certificate&nbsp;<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>Below is the procedure to apply for an EC online:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Visit your State\u2019s official land registration website and select the option to apply for an EC.<\/li><li>Enter all the required details &amp; then click save\/update.<\/li><li>Enter the period for which you require the EC and then click on \u2018Calculate Fee\u2019.<\/li><li>Upon paying the required application fee, you\u2019ll be directed to the \u2018Acknowledgment\u2019 window. Click on \u2018View Acknowledgement\u2019, and you\u2019ll be allowed a print of the acknowledgement.<\/li><li>An inspection will be carried by an inspector from the land records department for verification.\u00a0<\/li><li>After the completion of the inspection, an EC will be issued of all transactions which occurred during the specified period. In case there were zero transactions during the period, then a nil EC will be issued.<\/li><\/ol>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Finally\"><\/span><strong>Finally!<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>Aside from making sure that the EC is made available by the seller, the buyer must also follow due diligence and make personal checks to ensure that the property in question is free from any encumbrance. While the documentary proof surely acts as a safety net, land-related frauds in plot sales in rural areas are quite common.
